Conciliation

society Maturity 11-13 Next article →

Sometimes people have a big disagreement. This is often called a dispute. One way to fix this is called conciliation.

It is a way to solve problems without a court. A neutral person helps the people involved. We call this person a conciliator. They do not take sides in the fight. Their job is to help everyone reach an agreement. This method is very helpful for many different groups.

Conciliation works in a very special way. The conciliator helps by lowering tension between people. They work to improve how everyone talks to each other. Sometimes they meet with everyone together. Other times, they meet with people one by one.

They help people understand the main issues clearly. This helps the parties find a way to agree. The conciliator does not make a final rule. They do not call witnesses or look for evidence. The final choice belongs to the people in the dispute.

This process is different from other legal ways. It is not like litigation or arbitration. Litigation is a formal way to solve problems in court. Arbitration is when someone else makes a binding choice.

Conciliation is voluntary, which means people choose to do it. It is also private and flexible. The process can start very quickly. Both sides can agree to start within 12 hours. This can be part of a contract made before a fight. It can also happen after a dispute starts.

Many different places use this helpful method. It is used for peace efforts in the world. It is used for people who make laws. It is even used for intellectual property issues.

Some conciliators work for big government groups. In the United States, there is the Federal Mediation and Conciliation Service. In the United Kingdom, there is a group called Acas. Acas has a Chief Conciliator and a team of workers. Joanna Nunn was named the new Chief Conciliator at Acas.

Most successful conciliators are very skilled at negotiating. Negotiating is the art of helping people reach a deal. In international law, this might include shuttle diplomacy.

This is a way to move toward a resolution. People can pick a conciliator they both like. Or, they can use an appointing institution to choose one. This method helps people solve problems on their own. It allows them to find a fair and mutual outcome.
