Instead of a judge making a rule, a neutral person helps. This person is called a mediator. They do not take sides in the fight. Their main job is to help everyone talk to each other. This process is called being "party-centered." This means the people in the dispute decide the answer themselves. The mediator uses special skills to guide the conversation. They help people focus on what they truly need. This makes it easier to find a good solution.

There are different ways a mediator can work. In one way, they use facilitative mediation. This helps people understand how the other person feels. In another way, they use evaluative mediation. Here, the mediator looks at the facts and suggests ideas. However, they still do not force a specific choice. This is very different from a court or an arbitrator. A judge has the power to make a binding decision. A mediator does not have that kind of power. The final agreement must be something everyone chooses to do.

People have used mediation for a very long time. It appeared in ancient times in places like Greece. The Romans also used mediators and gave them many names. One name they used was "mediator."

In the year 21 or 20 BC, mediators helped the Kushites. They worked with a leader named Augustus to make a peace treaty. Even in the first century, Saint Paul asked people to use mediation. Today, mediation is a professional job. People go to special training programs to earn certifications.

Mediation has many helpful benefits for everyone involved. One big benefit is that it saves money and time. A court case can take many years to finish. Mediation can often reach a solution in just a few hours.

It is also a very private process. Unlike a public court, what happens in mediation stays secret. This is called confidentiality. This helps people feel safe while they talk. It also helps people keep their relationships strong after the fight ends.

Many different groups use mediation in their daily lives. Families use it for things like divorce or parenting plans. It is also used in workplaces for many different reasons. In Australia, the government changed how they handle workplace disputes. They moved from old systems to using more private mediation.
