Solicitation

society Maturity 11-13 Next article →

Solicitation is a word with several different meanings. One way to use it is to describe offering to buy goods or services. However, the word also has a special meaning in the world of law. In the United States, solicitation is a type of crime. This is known as an inchoate offense. An inchoate offense is a crime that is just beginning. It happens when one person tries to start a crime. They might offer money or use words to persuade another person. The person must truly intend for a crime to happen.

How does this crime work in court? To prove it, officials must show a specific intent. The person must want someone else to commit a felony crime of violence. They might command, induce, or persuade the other person. It is a crime even if the act never happens. For example, if Alice tells Bob to hurt Charlie, Alice is guilty. It does not matter if Bob says no. It also does not matter if Bob is actually an undercover officer. The crime is in the attempt to start the bad act.

Laws about solicitation change depending on where you are. In England and Wales, the rules are different. The Street Offences Act 1959 is one such law. It deals with people loitering in public places for prostitution. You should not confuse this with a solicitor in the UK. In those countries, a solicitor is a type of lawyer. They can act as an agent for a client. They might even find a barrister for that client.

There are real cases that show how these laws work. In March 2014, an event happened in Dothan, Alabama. An activist named Christopher Rufo was arrested in a public restroom. An officer claimed Rufo tried to solicit prostitution. The officer said he saw a ten-dollar bill under a partition. The officer also saw a book by C. S. Lewis. However, a judge later dismissed all the charges. The judge ruled that the officer violated Rufo's privacy. The officer had been spying through the doorway before the incident.

Finally, solicitation can refer to people selling things at your door. This is why many people use "no soliciting" signs. These signs tell door-to-door salesmen to stay away. In many places, the seller must look for these signs. If they see one, they must leave the area. Some cities have very strict rules for these workers. Employers may have to train staff on local laws. Workers might also need to wear an identifying badge. This helps people know who is at their door.
