License

society Maturity 11-13 Next article →

A license is an official permission or permit to do, use, or own something. It also refers to the actual document that proves this permission exists. In legal terms, a license can be seen as a "promise not to sue." This is because many activities are otherwise illegal or would violate someone else's rights. For example, driving a car on public roads is forbidden without a government permit. Using a copyrighted song without permission could lead to a lawsuit. A license allows a person or company to engage in these activities legally.

To understand how a license works, we must look at the two parties involved. The person or group giving the permission is called the licensor. The person or group receiving the permission is called the licensee. In government settings, a person obtains a license by applying for it. They may need to pay a fee or prove they have a certain skill. In private settings, a license is usually created through a specific agreement or contract. This agreement can be written or, in some cases involving land, made orally.

Intellectual property licensing is a major part of modern business and academia. Intellectual property refers to creations of the mind, such as inventions, software, or art. When a licensor grants a license for these items, they include specific rules. One key rule is the term, which is the length of time the license lasts. This helps the licensor if market conditions change later. Another rule is the territory, which defines the geographic area where the license works. A license limited to North America would not protect a user in Kyrgyzstan.

Patent licensing is a very specific type of intellectual property agreement. A patent owner has the right to an invention, but they can license it to others. This allows others to make, use, sell, or import the patented product. These agreements can be exclusive, meaning only one licensee has the rights. They can also be non-exclusive, meaning many people can hold the same rights. To pay for these rights, licensees often pay royalties. A lump sum is a single upfront payment. A running royalty is a periodic payment based on how many products are sold.

Trademark and brand licensing works in a similar way for famous names. A company might license its trademark, such as a logo, to another business. For instance, McDonald's licenses its "Golden Arches" and "Big Mac" name to franchisees. These businesses must follow strict quality standards to keep their permission. If they fail to meet these standards, the licensor can take the rights back. Artwork and character licensing also exists for creative works. A person can get permission to use characters like Mickey Mouse without fear of copyright infringement.

Software uses a very common type of license called an End-User License Agreement, or EULA. When you install software on a computer, you are typically agreeing to these terms. Most software licenses are associated with a unique code for access. These agreements often limit how many computers you can install the software on. In the world of real estate, a license is different from a lease. A license gives someone permission to act on another person's land. However, it does not give them a permanent interest in that land. A license is often revocable, meaning the owner can take it back at will.

In academia, the term takes on a different meaning through the licentiate. A licentiate is an academic degree that traditionally allowed someone to teach or practice a profession. In France, a licence is the first degree awarded at universities. In countries like Sweden and Finland, a licentiate is a postgraduate degree. It sits between a master's degree and a doctorate. This is a helpful option in systems where a full doctorate takes five or more years. Whether it is for a car, a patent, or a degree, licenses provide a structured way to manage rights and rules.
