Legal fiction

society Maturity 11-13 Next article →

Lawyers sometimes use a special tool called a legal fiction. This happens when the law treats something as true. It might not be literally true in real life. However, this helps the law reach a fair result. Some people call these rules "scaffolding" for a building. This means they help hold things up while the law grows.

One example is child adoption. When a child is adopted, the new parents become the legal parents. This is true even if they are not related by blood. Another rule helps when people die at the same time. If it is impossible to know who died first, the law says the older person died first. This helps with rules for passing on money.

Courts also use these rules in other ways. They might treat a large company like a single person. This lets a company own things or sign papers. Sometimes, a court might treat a piece of property like a person. This is called "in rem" jurisdiction. In the United States, this can lead to funny case names. One case was about "50,000 Cardboard Boxes."
