The Supreme People's Court (SPC) supervises all other courts and answers directly to the NPC. The Supreme People's Procuratorate (SPP) is responsible for carrying out prosecutions. In 2018, the government also established the National Supervisory Commission (NSC). The NSC was created to investigate corruption within the state organs and the CCP. All legal personnel are under the control of the Central Political and Legal Affairs Commission.
The relationship between the CCP and the state is deeply integrated. The CCP constitution states that the party is the highest force for political leadership. All government departments and state-owned enterprises have internal CCP committees. These committees lead the decision-making process within those institutions. Even at the village level, the party maintains a presence through these committees. While there were proposals in the past to separate the party from the state, these ideas were abandoned after the 1989 Tiananmen Square protests. Today, the integration of the party and the state has continued to accelerate.
China's governing rules have been defined by several different constitutions. The first constitution was created on September 20, 1954. A second version in 1975 was much shorter and focused on revolutionary language. The third version in 1978 was influenced by the Cultural Revolution. The current constitution was declared on December 4, 1982. This is the fourth constitution of the PRC. It guarantees the legal power of the CCP and ensures its control over the military, the media, and the government.
