The government of the People's Republic of China (PRC) operates as a unitary communist state.

In this system, the Chinese Communist Party (CCP) holds supreme political leadership. The government functions through a system of people's congresses. These congresses allow the CCP to enact and implement its policies across the nation. Unlike many other countries, China does not use a separation of powers. There is only one branch of government, which is represented by the legislature. This means all state organs must follow the direction set by the ruling party.

The National People's Congress (NPC) is the highest state organ of power in China.

It is the largest parliamentary body in the world, with 2,977 members in 2023. The NPC meets annually in March for about two weeks in Beijing. During these sessions, delegates review and approve major policy directions. Because the full NPC meets only once a year, much of the daily work is done by the NPC Standing Committee (NPCSC). The NPCSC adopts most national legislation and interprets the constitution. The chairman of this committee is one of the most important officials in the country.

Leadership in China follows a strict hierarchy and a specific ranking system. The most powerful position is often called the paramount leader. Currently, Xi Jinping holds this role by leading three major offices. He is the General Secretary of the CCP, the President of the PRC, and the Chairman of the Central Military Commission. While the presidency is officially a ceremonial office, the leader of the CCP has held it since the 1990s. The top decision-making group is the Politburo Standing Committee. As of 2024, this committee consists of seven members who discuss major issues and set policy.

It is also known as the Central People's Government. The head of the State Council is called the Premier. This body includes a Premier, several vice premiers, and 26 ministers. The State Council is responsible for implementing the policies that the CCP and the NPC have approved. Before the State Council presents initiatives to the NPCSC, they must often receive endorsement from the CCP's Politburo Standing Committee. This shows how closely the party and the state work together.

China's judicial system is composed of political organs that perform court functions.

Because these organs are part of the political system, China does not have judicial independence. The Supreme People's Court (SPC) supervises all other courts and answers directly to the NPC. The Supreme People's Procuratorate (SPP) is responsible for carrying out prosecutions. In 2018, the government also established the National Supervisory Commission (NSC). The NSC was created to investigate corruption within the state organs and the CCP. All legal personnel are under the control of the Central Political and Legal Affairs Commission.

The relationship between the CCP and the state is deeply integrated. The CCP constitution states that the party is the highest force for political leadership. All government departments and state-owned enterprises have internal CCP committees. These committees lead the decision-making process within those institutions. Even at the village level, the party maintains a presence through these committees. While there were proposals in the past to separate the party from the state, these ideas were abandoned after the 1989 Tiananmen Square protests. Today, the integration of the party and the state has continued to accelerate.

China's governing rules have been defined by several different constitutions. The first constitution was created on September 20, 1954. A second version in 1975 was much shorter and focused on revolutionary language. The third version in 1978 was influenced by the Cultural Revolution. The current constitution was declared on December 4, 1982. This is the fourth constitution of the PRC. It guarantees the legal power of the CCP and ensures its control over the military, the media, and the government. This document provides the legal framework for the country's entire political structure.
