Divorce

society Maturity 11-13 Next article →

Divorce is the legal way to end a marriage. It is also called the dissolution of marriage. When a marriage ends, the law must reorganize certain duties. These duties include how to share property and money. Courts also decide how to care for children through child custody. This includes rules for parenting time and child support.

Most countries require people to have only one spouse at a time. This is called monogamy. Because of this, a divorce allows former partners to marry someone else. Divorce is different from an annulment. An annulment declares that a marriage was never valid to begin with. There are also ways to separate without ending the marriage legally.

There are two main ways that divorce laws work. Some places use fault-based divorce. In these systems, one person must prove the other person did something wrong. They might claim things like cruelty or being unfaithful. Other places use no-fault divorce. In these places, people can separate for any reason. They do not have to prove anyone is at fault. Many places, like the US and France, offer both choices.

Some countries use a single rule. They might say a marriage has an irretrievable breakdown. This means the marriage cannot be fixed. The way people define a breakdown can change by country.

Laws about divorce often change as society changes. Many European countries have updated their rules recently. For example, Scotland changed its laws in 2006. France updated its rules in 2005. Switzerland also made changes in 2005. Greece changed its laws in 2008. In the UK, new laws started in April 2022. Now, people in the UK do not have to blame a spouse to end a marriage. These changes often make the waiting periods shorter. This helps people move on with their lives more quickly.

History shows that divorce laws are not the same everywhere. For a long time, almost all countries required proof of fault. This changed in the late 1960s and early 1970s. Many Western countries began using no-fault rules during this time. Some countries have only recently allowed divorce. Italy legalized it in 1970. Portugal did so in 1975. Brazil legalized it in 1977. Spain changed its laws in 1981. Argentina followed in 1987.

Other places like Chile and Malta changed more recently.

Not every country allows divorce at all. The Philippines and Vatican City are two examples. In the Philippines, divorce is not legal for most people. It is only allowed for some if a spouse is an undocumented immigrant. Vatican City is a state ruled by the head of the Catholic Church. Because of this, they do not allow divorce. In other places, people use different ways to settle disagreements. Some use mediation to find a fair solution. This can be less stressful than a big trial in court.
