Disownment

society Maturity 11-13 Next article →

Disownment is a very serious thing that happens in families. It is when a relative stops accepting a person as kin. This could be a parent or a sibling. The person might be cut off from family money. They might also be sent away from the family home. This is called familial exile. Sometimes, a family might shun a person. Shunning means the family ignores them.

This act changes how a person lives their life. It is different from giving a child up for adoption. Disownment is a social act between people. It can happen even when a person is an adult. The disowned person must find a new place to live. They must also find new ways to be cared for. This is similar to how divorce works for a spouse. They lose the support of their former family.

Many different groups have used these rules throughout history. In ancient Rome, leaders had special rights called patria potestas. These rights gave them the power of disownment. The Code of Hammurabi also had rules about this. In Louisiana, there was a rule called action en desaveu. This was a way to disown a child. The Tanala people of Ikongo also had a process for it. The Antandroy people used it as a punishment.

Laws about disownment are different in every country. In some places, it is illegal to disown a minor. A minor is a child who is not yet an adult. Some countries have very specific rules for this. In Spain, a person can disown a relative if there was abuse. In Austria, there must be an absence of normal family ties. These laws help decide when a family can break its bonds.

Disownment can also work in the other direction. A child might choose to leave their family. They might seek something called emancipation. This is a way to become free from their family. Sometimes, society and its institutions will accept these acts. It is a way to show how families change. People make many choices about who they belong to.
