A declaration of war is a formal act by a government. It announces that a state is starting or is already in a war. This act can be a public speech or a signed document. The person who signs it must be an authorized leader. In many countries, this power belongs to the head of state. This formal step helps define the legal state of war between nations.

Different nations have different rules for how this works. Some countries require approval before a formal announcement is made. In Australia, the Governor-General has the legal power to proclaim war. However, the Prime Minister and ministers usually handle military actions. In Brazil, the President can declare war if the National Congress allows it. In Austria, the Parliament must act and the President announces it. These rules help ensure that big decisions follow the law.

People have used formal declarations for a very long time. The ancient Sumerian Epic of Gilgamesh describes these events. The Roman Republic used a special ceremony called the Fetials. Some leaders in the past wanted these ceremonies to feel honorable. They believed a formal notice made a victory look more glorious. However, many wars happened without any official declaration at all. Between 1700 and 1870, only 10 wars were declared in Europe and the United States.

Rules for war have changed a lot since the World Wars. The Hague Convention of 1907 set rules for starting hostilities. Later, the League of Nations tried to prevent war through treaties. After World War II, the United Nations was created to keep peace. The UN Charter says nations should not use force against others. It also says a country has a right to defend itself. Because of these rules, formal declarations are now very rare in the world.

Today, many military actions happen without a formal declaration. During the Korean War, President Harry S. Truman called it a "police action." In the Russo-Ukrainian War, Russia used the term "special military operation" instead. Some small states still declare war when they are invaded by large powers. For example, Egypt declared war in 1948 and 1967. Iraq declared war on Iran in 1980. These modern examples show how the way countries fight is changing.
