Conversion (law)

society Maturity 11-13 Next article →

Conversion is a special kind of legal wrong called a tort. It happens when someone treats another person's property as if it were their own. This person acts in a way that goes against the real owner's rights. They might use the item or try to own it themselves. This can happen even if the person is not trying to be dishonest.

It is different from theft because theft is a crime. Conversion is a civil matter that focuses on the property itself.

To have a conversion, certain things must happen step by step. First, there must be an intent to use the property. This property can be something you can touch or something intangible. Second, the person must act in a way that interferes with the owner. This could mean taking a physical object or using a digital right. The person must have the right to possess the item immediately. They must also be acting without the owner's permission.

This legal idea has a very long history. In the year 1479, an early case involved gold cloth. A person changed the cloth into clothes for their own use. Later, the law grew through an action called trover. This helped fill a gap in old English laws. By 1554, a case called Lord Mounteagle v Countess of Worcester helped set a standard. In that case, someone found lost goods and kept them.

Many different things can be involved in these cases. You can have conversion involving animals if they are moved or hurt.

People can also face claims for cutting down trees. However, the trees must be severed from the land first. Buildings or machines can also be converted if they are removed from the land.

Even computer software or website names can be part of a claim in the United States.

This shows how the law changes with new technology.

Conversion helps people understand their rights to the things they own. It connects to how we treat lost and found items today. It also links to how we protect digital things like domain names. In the past, the law focused mostly on physical items like bolts of cloth. Now, the law covers almost any kind of private property. This includes both things we can hold and things we can only see on a screen.
