society Maturity 11-13 Next article →

In the world of law, the term "bar" has several important meanings. It can refer to a physical object in a room. It can also describe the entire legal profession. Most often, it refers to the group of people who practice law. The bar is a vital part of how courts function. It helps organize the people involved in a legal case.

Historically, the term comes from a physical barrier used in medieval European courtrooms. This barrier was often a piece of furniture. It served to divide the room into two distinct areas. One area was restricted to lawyers and court personnel. The other area was for the general public. This separation helped maintain order during legal proceedings. Most modern courts in the United States and Europe still use a physical partition. This might be a railing or a wooden barrier. This partition ensures the public stays in the correct area.

Beyond the physical room, the bar refers to the process of becoming a lawyer. In the United States, this is a formal qualifying procedure. Each individual state and its bar association administers this process. Usually, a candidate must first graduate from a qualified law school. After graduation, they must pass a difficult written test called the bar examination. Many states use a specific test called the Multistate Bar Examination, or the MBE. This is a multiple-choice exam taken on a single day. Some states use the Uniform Bar Examination, which includes the MBE. Other parts of the exam may focus on specific state laws. Once a candidate reaches the required score, they are admitted to the bar.

There are also special rules for certain types of legal work. For example, there is a procedure for the United States Patent and Trademark Office, or USPTO. This is often called the "patent bar." This exam is different from the general bar examination. It does not require a law school degree. Instead, applicants usually have a background in science or engineering. They often hold a bachelor's degree in a relevant field. People who pass this exam are called patent agents if they lack a general law license. If they do have a law license, they are called patent attorneys. Both can represent clients before the patent section of the USPTO. However, only licensed attorneys can handle other patent tasks like litigation.

In the United Kingdom, the legal profession is organized differently. The law is divided between two main types of professionals. These are solicitors and barristers. In Scotland, barristers are known as advocates. The term "the bar" in the UK refers specifically to the organization for barristers or advocates. When a person is admitted to this group, they are "called to the bar." There are even different levels within this group. The "inner bar" is reserved for senior King's counsel. The "outer bar" is for junior barristers. This shows how specialized the legal system can be.

We can also use the word bar to describe specific branches of law. For instance, the "tort bar" refers to lawyers who specialize in civil suits. This is a way to categorize lawyers by the type of work they do. The term is also used to distinguish lawyers from judges. We often use the phrase "the bench and the bar" to describe them together. The bar consists of the advocates who represent clients. The bench refers to the judges or the judiciary who adjudicate the cases. In some countries, judges were once lawyers and remain members of the bar. These lawyers are sometimes called Officers of the Court.

Understanding the bar helps us understand the structure of justice. It shows how professionals are trained and regulated. It also shows how courtrooms are organized to keep proceedings clear. Whether it is a physical railing or a professional license, the bar defines the boundaries of legal practice. It ensures that those who practice law are qualified and follow specific rules. This organization is essential for the legal systems used around the world.
