Acquittal

society Maturity 11-13 Next article →

An acquittal is a very important result in a criminal trial. It happens when the prosecution fails to prove a person is guilty. They must prove guilt beyond a reasonable doubt to win. When this fails, the court issues an acquittal. This is a legal order that clears the person of the charge.

It does not always mean the person is innocent. It just means the evidence was not strong enough. A person might also get a partial acquittal. This happens if they are found guilty of some charges but not others.

Rules for acquittals can change depending on where you live. In the United States, an acquittal is usually very final. This is because of a rule called double jeopardy. This rule stops the government from trying someone twice for the same crime. Even if new evidence is found later, the person cannot be retried.

There is one rare exception to this rule. If a person bribes a judge to get an acquittal, it is not valid. In that case, the person was never in real danger of being found guilty.

Other countries have different ways of handling these cases. In Canada, the government can appeal certain decisions to a higher court. They might appeal if a judge makes a mistake about the law. In England and Wales, the rules also allow for some appeals. The Criminal Justice Act 2003 lets them order a retrial for serious crimes. This can happen if new and compelling evidence is found later. They can also act if a person used threats against a juror or witness.

History shows that these rules have changed a lot over time. In England and Wales, an acquittal usually means a person is freed immediately. However, this was not always the case. Before the year 1774, people had to pay jailers to be released. Some people even died in jail because they could not pay these fees.

In Scotland, there used to be two different verdicts. They used "not guilty" and "not proven." The "not proven" verdict did not follow the same double jeopardy rules.

An acquittal affects a person's life in many ways. Even after being cleared, a charge might stay on a criminal record. In the United Kingdom, police can show acquittals during certain background checks. An acquittal also does not stop all legal problems. A person can still face a civil case in a different kind of court. For example, O. J. Simpson was acquitted of murder in 1995. But in 1997, he was held liable in a civil case for wrongful death.
