First, they must follow the rules written in the trust instrument. They cannot simply do whatever they want with the property. They must also be fair to every beneficiary. A trustee must act with loyalty and avoid conflicts of interest. They should not use the trust to make a personal profit. However, they may sometimes charge a fee for their hard work.

In the United Kingdom, the Charities Act 2006 changed how charities work. It helped create Charitable Incorporated Organisations, or CIOs. These are charities that have limited liability. In New South Wales, the Trustee Act 1925 sets rules for investing money. There are also many court cases, like Keech v Sanford from 1726. These old cases help explain what a trustee's duties are.

Different places use the word trustee in unique ways.

In Chapter 7 cases, these are called panel trustees. In every judicial district, there is also a permanent Chapter 13 trustee. These people ensure the bankruptcy process stays fair and honest.
