Statutory interpretation

society Maturity 11-13 Next article →

Laws are rules made by leaders. We call these laws statutes. Sometimes, the words in a law are not clear. This can happen if a word has two meanings. It can also happen when new technology is made.

A judge must decide what the law means. This work is called statutory interpretation.

Judges use special tools to help them. One way is to look at the plain words. They try to use the common meaning of a word. They also try to find the goal of the law. They want to know what the makers intended.

In England, courts used three main rules. These were the literal rule, the golden rule, and the mischief rule. In the United States, judges also look at the text first. They try to follow what is written. They also try to make sure every word has a purpose. This helps keep the law fair for everyone.
