Misdemeanor

society Maturity 11-13 Next article →

A misdemeanor is a type of crime. It is considered a lesser act in many legal systems. People often compare it to a felony. A felony is a much more serious crime. The main difference is how the law treats them. Laws often use the idea that punishment should fit the crime. This helps keep things fair for everyone.

There are many ways a person might be punished. Some people must pay a monetary fine. Others might perform community service to help others. Some people may have to go to jail for a short time. In the United States, this is usually no more than one year. These people often stay in a local jail. Felons usually go to a larger prison instead.

Rules for these crimes change depending on where you live. In the United States, the federal government uses the one-year rule. Some states have different limits. For example, Pennsylvania allows up to five years for certain misdemeanors. Other places like the UK and Australia do not use these names. They use terms like summary offences or indictable offences. This change happened in the UK in 1968.

Sometimes a small crime can become a much bigger one. This might happen if a person breaks the law many times. A repeat offender might face a felony charge instead. The situation can also change based on the context. For instance, indecent exposure is often a misdemeanor. It can become a felony if it happens in front of a minor. This shows how the law looks at the whole story.

Misdemeanors can also lead to other life changes. These are called collateral consequences. A person might lose a professional license or a job. This often happens if the crime is related to their work. For example, a driver might lose their license after reckless driving. In the US Constitution, the word is used for impeachment. Congress decides what counts as a high crime or misdemeanor.
