The primary role of a judge is to settle legal disputes. They must do this in a final and publicly lawful manner. Judges exercise significant governmental power in many societies. They can order police or military officials to conduct searches. They may also order arrests, imprisonments, or deportations. To ensure fairness, higher courts like supreme courts check their decisions.

The way a judge operates depends on the legal system in place. In an adversarial system, used in the U.S. and England, the judge acts like an impartial referee. In these cases, lawyers for the prosecution and defense present evidence to a jury. The jury acts as the main factfinder. The judge then ensures correct procedure and handles sentencing. In contrast, an inquisitorial system is common in continental Europe. In this system, there is no jury. The judge is the main factfinder who presides, judges, and sentences. Some systems even use an examining magistrate to conduct investigations.

Judges can be professional or volunteers. A volunteer judge, such as an English magistrate, does not require legal training. These volunteers are also unpaid. Professional judges must have a formal legal education. In the United States, this usually requires a Juris Doctor degree. Most professional judges are appointed from a pool of experienced attorneys.

Appointment methods vary by location. Some judges are chosen through direct elections. Others are appointed through indirect elections. In some non-democratic systems, appointments may be highly politicized. In those cases, judges might receive instructions on how to rule.

Being a judge is a demanding occupation that requires specific skills. They must research long documents and witness testimonies. A judge needs a deep understanding of legal procedure and complex laws. They must possess strong skills in logical reasoning and analysis. Excellent writing skills are also necessary for official documents. Because they work with people, they need good interpersonal skills. They must also possess good moral character and no history of crime.

In the U.S., the median salary for a judge is $101,690 per year. Federal judges earn between $208,000 and $267,000 per annum.

Gender representation among judges varies greatly by country. In several European civil law countries, women make up the majority. In Slovenia, Serbia, Latvia, Luxembourg, Greece, and Hungary, women represent over 70% of first-instance judges. However, the situation is different in common law countries. In the UK, Ireland, Malta, and the U.S., over 70% of first-instance judges are men.

Women are often underrepresented in supreme courts. An exception is Romania, where over 80% of High Court judges are women.

The term of office for a judge also changes based on the jurisdiction. In the U.S., federal judges have life tenure. They serve "for good behavior" unless they retire or are impeached. This has led to discussions about mandatory retirement ages. In 2015, 33 U.S. states and the District of Columbia had mandatory retirement ages. These ages usually range from 70 to 75. Vermont is an exception, where the age can be as high as 90. A 2020 study suggested that mandatory retirement can improve state Supreme Court performance.

Judges often use symbols and specific attire to mark their authority. Many wear long robes, which are often black or red. They sit on an elevated platform known as the bench. Some use a ceremonial hammer called a gavel.

In some Commonwealth nations, judges wear wigs for ceremonies. In Oman, judges wear a long red, green, and white stripe. In India, the way lawyers address judges has changed over time. Lawyers used to say "My Lord" due to English colonial traditions. Now, the Bar Council of India suggests using "Your Honour" instead.
