Charter

society Maturity 11-13 Next article →

A charter is a formal document that grants specific rights or authority. It acts as a written agreement where a granter recognizes the rights of a recipient. This process creates a specific relationship between the two parties. The granter always maintains superiority, which is also called sovereignty. The recipient accepts a limited or inferior status within that relationship. This structure is still used in many modern legal and organizational settings.

The word itself has a deep history. It comes from the Greek word *chartēs*, meaning a layer of papyrus. It moved from Greek into Latin, then into Old French, and finally into English. Historically, charters served many different functions depending on the era. In early medieval Britain, they were used to transfer land from donors to recipients. Today, the term is often used as a synonym for a grant of privileges.

There are many distinct types of charters used in history and law. One type is the royal charter, which is issued by a monarch. These are formal grants issued under royal prerogative as letters patent. Historically, they were used to create public laws. A famous example is the Magna Carta, also known as the Great Charter, from 1215. Since the 14th century, they have mostly been used to grant powers to individuals or groups.

Another important type is the Anglo-Saxon charter, often called a diploma. These documents were created in Britain between the seventh century and 1066. They were usually written in Latin on parchment. Around 200 of these original documents have survived to the present day. The oldest ones granted land and privileges to the church. By the 8th century, they were increasingly used to grant land to lay people.

Charters also play a role in how governments and businesses are organized. A corporate charter establishes the existence of a corporation in the United States and Canada. In the United States, the Congress issued federal charters from 1791 until 1992. These were laws that defined the mission and authority of specific groups. Similarly, a municipal charter allows a local governing body to become self-governing. This includes cities, towns, and even villages under state or provincial laws.

In more modern settings, charters are used for specific management and education tasks. A project charter is used in project management to authorize a new project. It is provided by a sponsor to define roles, responsibilities, and objectives. It also identifies key stakeholders and the authority of the project manager. In education, a charter school is an exception to the standard rules. These schools follow different regulations and statutes than traditional state schools.

Some charters serve to preserve history or manage specific movements. An *inspeximus* charter is a special kind of royal charter. The name is Latin for "We have inspected." These documents recite and incorporate earlier charters into a new one. This was often done to confirm or renew the validity of a foundation, like a monastery. In political uprisings, a charter might outline the goals and structure of a movement. This helps define the roles and responsibilities of all members involved.
