Belyaev's early life involved many different career paths. He was born in Smolensk to an Orthodox priest. His father initially enrolled him in a Smolensk seminary to follow family traditions. However, Belyaev did not feel religious and became an atheist during his studies. After graduating, he chose to study law instead of taking religious vows. In 1914, Belyaev left the legal profession to focus on literature. This transition coincided with a major health crisis. At age 30, he contracted tuberculosis. The infection eventually spread to his spine. This caused him to suffer from paralysis of the legs for six years. He endured constant physical pain during this period. To seek better treatment, he moved to Yalta with his mother and his nanny. While recovering in the hospital, he read authors like H. G. Wells and Jules Verne. He also began writing poetry from his hospital bed.

By 1922, Belyaev had overcome the disease. He moved to Moscow in 1923 to begin his serious literary career. He worked as a legal consultant for various Soviet organizations to support himself. His first major science fiction novel, *Professor Dowell's Head*, was published in 1925. He later moved to Leningrad in 1931 to live with his wife and oldest daughter. In 1934, he had the notable experience of meeting the famous English writer H. G. Wells during Wells's visit to the USSR.

After his death, complex legal issues arose regarding his work. Soviet law originally placed his works in the public domain 15 years after his death. Later, Russian laws changed how long copyright lasted. In 1993, the term became 50 years after an author's death. A 2004 update extended this to 70 years. This law also added 4 years for authors who worked or fought during the Great Patriotic War. These changes led to a major copyright dispute in 2008. The Terra publishing company sued other companies over the rights to his books. After several court rulings, a settlement was finally reached in 2012.
