France operates under a semi-presidential system. This structure is defined by the Constitution of the Fifth Republic. This constitution was approved by a popular referendum in 1958. It significantly increased the power of the president. The nation describes itself as an indivisible, secular, and democratic Republic. It also emphasizes a social Republic. The system relies on a separation of powers. This ensures that no single part of government holds total control.

The executive branch manages the daily operations of the state. It consists of two main parts: the president and the government. The president is the most important political figure. To win, a candidate must receive a majority of non-blank votes. This means at least half of the voters support them. The president appoints the prime minister. The president also chairs the Council of Ministers. This is a weekly meeting held at the Élysée Palace.

The government is led by the prime minister. It includes various ministers who manage specific areas. For example, the Ministry of Defence handles the military. The Ministry of the Interior manages law enforcement. Ministers can propose new laws to Parliament. They can also issue certain regulations called decrees. These decrees must be signed by the president or the prime minister. Some decrees are signed during the Council of Ministers meetings.

Power sharing can change depending on elections. If the president's party controls Parliament, the president is very dominant. However, if opponents control Parliament, the president's power is limited. This situation is called cohabitation. Before 2002, cohabitation happened more often. This was because the president served seven years while Parliament served five. Now, both terms are five years long. This change makes cohabitation less likely to occur.

The legislative branch is known as Parliament. It consists of two separate houses. The first is the National Assembly, which is the lower house. The second is the Senate, which is the upper house. Parliament passes statutes and votes on the national budget. It also monitors the executive branch. Members can ask ministers questions on the floor of Parliament. This process is called "questions au gouvernement."

The judicial branch ensures laws are followed correctly. It uses a civil law system. This system evolved from the Napoleonic Codes. The judiciary is divided into two distinct branches. The judicial branch handles civil and criminal law. The administrative branch handles appeals against government decisions. The Court of Cassation is the highest court for judicial matters. The Conseil d'Etat is the highest court for administrative matters.

A group called the Constitutional Council protects the constitution. It checks if new laws follow the nation's founding rules. Members are appointed by the president and leaders of Parliament. Former presidents can also serve on this Council. The constitution values the Declaration of 1789. This document includes the Rights of Man. It protects freedom of speech and religion. It also guarantees the presumption of innocence.

France is a unitary state with local subdivisions. These include regions, departments, and communes. The national government cannot interfere with their normal operations. France is also a founding member of the European Union. Because of this, France has transferred some sovereignty to European institutions. The French government must follow European treaties and regulations. In 2023, France was ranked 10th in the world for electoral democracy. This reflects its status as a major democratic power.
