Murder is defined as the unlawful killing of another human being without justification or excuse. This legal concept requires a specific state of mind known as intent. The laws governing murder vary significantly depending on the specific jurisdiction. Most societies view murder as an extremely serious crime. Because of this, legal systems use harsh punishments. These punishments aim to provide retribution, deterrence, rehabilitation, or incapacitation.

To understand murder, one must examine the technical concept of malice aforethought. In a legal sense, malice is not just an emotion. It refers to the mental state of the person committing the act. There are four recognized states of mind that constitute this malice. First is the direct intent to kill another person. Second involves acting with a reckless indifference to human life. This is sometimes called an abandoned and malignant heart. Third is the felony-murder doctrine, where death occurs during a dangerous felony. Fourth involves specific circumstances like those found in Spanish law, such as treachery or financial reward.

Legal systems often distinguish murder from manslaughter based on these mental states. Manslaughter is a killing committed without malice. Voluntary manslaughter may occur due to reasonable provocation or diminished capacity. Involuntary manslaughter occurs when a killing lacks most guilty intent but involves recklessness. Some jurisdictions also recognize mitigating factors like loss of control. These factors might reduce a murder charge to a lesser offense. This often happens if a jury feels sympathy for a defendant.

Many legal systems divide murder into different degrees. In the United States and Canada, the most common division is between first-degree and second-degree murder. First-degree murder is an aggravated form of the crime. It often requires premeditation, which means planning the act in advance. It can also involve specific methods like poisoning or lying in wait. Second-degree murder is often treated as common law murder. Some states even have a third-degree murder classification. In Florida, third-degree murder is defined as felony murder. In Minnesota, it is defined as depraved-heart murder.

The history of the word murder traces back to ancient languages. It descends from the Proto-Indo-European root *mŕ̥-trom, which meant killing. In Proto-Germanic, words like *murþrą and *murþrijô referred to killing and murderers. These evolved into the Old English morðor, meaning unlawful killing or crime. The modern English word was also influenced by Old French. Historically, the definition of life and death has changed. At common law, life ended with cardiopulmonary arrest. Today, courts often recognize the irreversible cessation of all brain function.

Punishments for murder are among the most severe in the legal world. In the United Kingdom, the law mandates life imprisonment for murder. Canada also uses life sentences for first-degree and second-degree murder. In India, the law provides for the death penalty or life imprisonment. Some United States federal laws allow for death or life imprisonment. New Zealand presumes a life sentence for murder unless it is unjust. These laws reflect how different nations value human life and order.

Murder laws connect to broader concepts of justice and human rights. The definition of a "human" remains a complex legal issue. This includes debates over when life begins during fetal development. Courts must also decide if an act was truly unlawful. For example, killings during war or self-defense are usually justified. The way a society defines murder shows its values. It reveals how a culture balances punishment with the protection of individuals.
