This meant many Black people did not have their rights protected. After the American Civil War, the Constitution was changed in 1866. These changes helped extend rights to people of color. Later, in 1920, women gained the right to vote in the United States.

Negative liberty is the freedom to act without unnecessary interference. Positive liberty is having the access to resources needed to reach goals. Both must exist within a fair legal system.

Some thinkers distinguish between the terms "freedom" and "liberty." Freedom is often used to mean the power to do what one wants. Liberty is seen as the absence of arbitrary restraints. This means liberty must respect the rights of all people involved. One must use freedom responsibly under the rule of law. This ensures that one person's actions do not take away another person's freedom. In some cases, liberty can even be taken away as a punishment for crimes.

Philosophers have debated the nature of liberty for centuries. The Roman Emperor Marcus Aurelius wrote about it in the second century AD. Later, Thomas Hobbes described liberty in the 1600s. John Locke rejected some of those earlier definitions. In 1859, John Stuart Mill wrote a famous work called "On Liberty."

Mill was the first to distinguish between the freedom to act and the absence of coercion. In 1958, Isaiah Berlin formally defined two opposite concepts. Negative liberty protects individuals from tyranny and the arbitrary exercise of power. Positive liberty refers to self-mastery and freedom from inner fears or weaknesses.

Political liberty has its roots in ancient Greek ideas. To the Greeks, being free meant not having a master.

Aristotle linked liberty to the principles of democracy. He argued that a freeman should be able to live as he likes. However, these rights were not for everyone in Greece. Women could not vote and were dependent on male relatives. Other empires had different approaches to freedom. The Persian Empire allowed religious freedom and abolished slavery around 550 BC. In the Maurya Empire of ancient India, Ashoka the Great promoted tolerance and equality through his edicts.

During the Age of Enlightenment, ideas about universal rights began to grow. Thinkers developed the social contract theory. This theory was suggested by Plato and later shaped by Hobbes, Locke, and Rousseau. They argued that law gives a king his power rather than the other way around. This moved the focus toward individual liberty as a fundamental reality. A 2024 study shows that liberty is not just a Western idea. Global concepts of liberty formed during the late Middle Ages through interactions across Afro-Eurasia. This happened through multilingual governance and the spread of religions.

England has a long history of legal documents regarding liberty. In 1215, the Magna Carta was enacted.

This document became a cornerstone for liberty in many nations. Other important English laws include the Petition of Right in 1628 and the Habeas Corpus Act in 1679. The Habeas Corpus Act stopped unlawful or arbitrary imprisonment. In 1772, a court judgment found that slavery was unsupported by common law in England and Wales. These laws helped build the framework for modern civil rights.

The United States has also struggled to define liberty for all people. The 1776 Declaration of Independence claims all people have a right to "Life, Liberty and the pursuit of Happiness."

However, for 90 years, the country practiced legalized Black slavery. Many argued that slave owners' liberty included the right to own property in people. The Supreme Court upheld this in the 1857 Dred Scott decision. After the Civil War, the Constitution was amended in 1866 to extend rights to people of color. In 1920, voting rights were finally extended to women. These changes were part of a long effort to make liberty more universal.
