Legal remedy

society Maturity 11-13 Next article →

Sometimes people do things that are wrong. A court can help fix these problems. This help is called a remedy.

There are three main types of remedies. The first type uses money. These are called legal remedies. A judge may order one person to pay another. This money is often called damages. Some damages help cover a loss. Other damages punish a person for being very bad. This can stop others from doing the same thing.

The second type is called an equitable remedy. These do not use money. Instead, a judge orders an action. For example, a judge can issue an injunction. This is an order to stop doing something. A judge might also use specific performance. This means the court makes someone finish a job they promised to do.

The third type is a declaratory remedy. In this case, the court does not give money. It also does not order an action. The court just explains the law. It might decide who owns a piece of land. It might also say what a contract means. These rules help keep things fair for everyone.
