The Kashmir conflict is a major territorial dispute in Asia. It involves three countries: India, Pakistan, and China. India claims the entire former princely state of Jammu and Kashmir. It bases this claim on an instrument of accession signed in 1947. Pakistan claims most of the region due to its Muslim-majority population. China claims the northeastern parts, including Aksai Chin and the Shaksgam Valley.

The region is currently divided into three distinct administrative zones. India controls about 55% of the total land area. This includes the Kashmir Valley, Jammu, most of Ladakh, and the Siachen Glacier. This area holds 70% of the total population. Pakistan controls approximately 30% of the land. This includes the areas known as Azad Kashmir and Gilgit-Baltistan. China controls the remaining 15% of the territory. This includes Aksai Chin and the Trans-Karakoram Tract.

To understand the conflict, one must look at the history of the Dogra dynasty. In 1846, the Treaty of Amritsar transferred Kashmir to Gulab Singh. He became the first Maharaja of Jammu and Kashmir. The state remained a princely state under British Paramountcy until 1947. This meant the British Raj managed external affairs and defense. According to the 1941 census, the population was 77% Muslim and 20% Hindu. Despite this, the administration was dominated by Hindu rulers. This created social tension because many Muslims faced high taxes and few opportunities.

The conflict escalated during the 1947 partition of British India. The partition created the new nations of India and Pakistan. The Maharaja, Hari Singh, initially wanted to keep his state independent. However, Pakistani tribal militias invaded the state in September 1947. This invasion was supported by officials from the Northwest Frontier Province. The Maharaja's troops could not stop the attack. He requested military help from India. To receive this aid, he signed an instrument of accession on October 26, 1947.

Since 1947, several wars and skirmishes have shaped the region. The first war ended with a UN-mediated ceasefire. This established a boundary known as the Line of Control. China entered the conflict in 1962 during a war with India. In 1965, Pakistan attempted to start an insurgency, leading to another war. The 1971 war eventually led to the Simla Agreement. This agreement formally established the current Line of Control. Later, an armed conflict occurred in Kargil in 1999.

Internal unrest has also caused significant hardship for civilians. An armed insurgency began in the Kashmir Valley in 1989. This movement sought self-determination or merger with Pakistan. The fighting resulted in tens of thousands of casualties. In the early 1990s, many Kashmiri Hindus fled the valley. The region has seen heavy militarization and civil unrest. Large-scale demonstrations occurred in 2010 and 2016. These protests were often triggered by specific deaths or security actions.

Human rights organizations have raised serious concerns about the region. Amnesty International has reported abuses in both Indian and Pakistani-administered areas. In Indian-administered Kashmir, scholars cite issues like extrajudicial killings and enforced disappearances. Amnesty International notes that military members are often not tried in civilian courts. In Azad Kashmir, authorities have been accused of strict controls on basic freedoms. The UN Office of the High Commissioner for Human Rights has released reports on these situations. The conflict remains a complex link between regional politics and human rights.
