The International Criminal Court, known as the ICC, is a permanent international tribunal. It is located in The Hague, Netherlands.

The ICC is an intergovernmental organization. Its main purpose is to prosecute individuals for the most serious international crimes. These specific crimes include genocide, crimes against humanity, war crimes, and the crime of aggression. The ICC is unique because it is the first and only permanent court of its kind. It serves as a "court of last resort." This means it does not replace national legal systems. Instead, it complements them. The ICC only exercises its jurisdiction when a national court is unwilling or unable to prosecute.

There are three specific ways the court can begin its work. This process is often called "triggering" the court's jurisdiction. First, a state party can refer a situation to the court. Second, the United Nations Security Council can refer a situation. Third, the Office of the Prosecutor can initiate an investigation on its own. This is known as acting proprio motu. When the prosecutor finds a reasonable basis to proceed, an investigation becomes mandatory. The prosecutor must balance the gravity of the crime against the interests of justice.

The court has four main organs that allow it to function. These are the Presidency, the Judicial Divisions, the Office of the Prosecutor, and the Registry.

The idea for a permanent international court has a long history. The concept was first proposed during the Paris Peace Conference in 1919. After the Second World War, special courts were created to judge leaders. These included the International Military Tribunal in Nuremberg and the International Military Tribunal for the Far East in Tokyo. In 1948, the United Nations General Assembly recognized the need for a permanent court. However, the Cold War made this goal difficult to achieve for many years. Advocates like Benjamin B. Ferencz and Robert Kurt Woetzel worked hard to promote the rule of law.

Their efforts helped move the idea toward reality.

In the 1990s, new developments pushed the court closer to existence. The UN Security Council created ad hoc tribunals for Yugoslavia and Rwanda. These temporary courts showed the world the need for a permanent system. In 1998, a major conference was held in Rome. This meeting aimed to finalize a treaty called the Rome Statute. On July 17, 1998, the Rome Statute was adopted by a vote of 120 to seven.

The treaty officially entered into force on July 1, 2002. This date marks the formal establishment of the ICC. Since then, the court has grown into a major international institution.

The court is managed by the Assembly of States Parties. This body consists of one representative from each member state. As of October 2024, there are 125 states parties to the Rome Statute. The Assembly elects officials and approves the court's budget. However, not all countries belong to the ICC. Major powers such as China, India, Russia, and the United States are not members. These nations do not recognize the court's jurisdiction. This lack of universal membership can affect how the court operates globally.

Since its start, the ICC has reached several major milestones. The court issued its first arrest warrants in 2005. In 2012, it delivered its first judgment. This case involved Congolese rebel leader Thomas Lubanga Dyilo. He was found guilty of war crimes regarding the use of child soldiers.

More recently, the court has issued arrest warrants for very high-level officials. These include Russian president Vladimir Putin. It has also issued warrants for Israeli leaders like Benjamin Netanyahu and Yoav Gallant. It has also targeted several Hamas leaders.

Despite its importance, the ICC faces many challenges and criticisms. Some opponents question its legitimacy. They argue that the court might interfere with national sovereignty. Others claim the court is susceptible to political influence. There have also been accusations of bias. Some critics argue the court disproportionately targets African leaders. There are also practical concerns about its effectiveness. The court relies on states to cooperate with arrests. Some people also point to the high cost of proceedings and the small number of convictions. The ICC continues to work within these complex political and legal systems.
