Decree

society Maturity 11-13 Next article →

A decree is a formal legal proclamation. It is usually issued by a head of state, a judge, or a royal figure. These official announcements follow specific procedures. These procedures are often defined by a nation's constitution or its customary laws. A decree serves as a tool for authorities to establish rules or make important decisions.

Because they carry legal weight, decrees help govern how societies function and how leaders exercise their power.

The mechanism of a decree involves following established legal frameworks. In many systems, the authority to issue a decree must come from a higher source, such as a constitution. For example, in France, executive orders must not violate the French Constitution or the Civil Code. If an order is found to be illegal, a party can request that the Council of State annul it. In some cases, such as in Turkey, certain decree laws require approval from a parliament to gain full legal power. This ensures that the power to make rules remains balanced within the government.

Decrees can be divided into several distinct types based on who issues them and what they do. In France, they are classified into regulations and particular measures. Regulations include application decrees, which help implement existing statutes. They also include autonomous regulations, which function as primary legislation in areas where the Constitution does not require statute law. There are also particular measures, such as the nomination of high-level civil servants. In Portugal, the system is even more varied. They use decree-laws, regional legislative decrees, and decrees from the President of the Republic to manage different levels of government.

History shows how the use of decrees has changed over time. In the Catholic Church, the term is quite ancient. The Pope uses legislative acts like a papal bull or a motu proprio, which are types of decrees. In 1917, Pope Benedict XV changed how Roman Congregations used their power to issue decrees. In Russia, the term evolved through different eras. After the Russian Revolution, government proclamations were often called decrees. During the Soviet Union, the government and the Communist Party issued proclamations known as Decisions. Today, under the 1993 Russian Constitution, a presidential decree has the force of law.

Specific numbers and articles often define the power of a decree. In Kazakhstan, Article 45 of the Constitution defines presidential decrees as binding throughout the entire territory. In Italy, clause 77 of the Constitution states that certain effects can be produced immediately for sixty days. In Portugal, the government uses Article 198 to define its legislative powers for decree-laws. In Turkey, the 1982 Constitution regulated decree laws through Articles 87 and 91. These specific rules ensure that every decree has a clear legal boundary and a defined purpose within the state.

There are many notable examples of how decrees function in different political systems. In Iran, the Supreme Leader uses decrees to delineate general policies for the Islamic Republic.

In Syria, following a Constitutional Declaration in March 2025, the President issues various orders to manage state affairs. This includes managing public resources and rebuilding institutions. In Saudi Arabia, royal decrees work alongside Sharia to serve as the primary sources of law. These examples show that decrees can range from managing daily administration to setting the highest policies of a nation.

Decrees connect different branches of government and various legal systems. They act as a bridge between the broad principles of a constitution and the practical needs of a country. In the United Kingdom, Orders-in-Council can act as either primary or secondary legislation. In Belgium, decrees are used by regional parliaments, such as the Flemish Parliament, to govern specific communities. By allowing leaders to act within a structured legal framework, decrees help maintain the organization of modern societies. They are essential components of how law is practiced and applied across the globe.
