There are three main types of trespass.

First, there is trespass to land. This is when someone enters a place they do not own.

You do not always have to hurt anything to break this rule.

Second, there is trespass to things. This is called trespass to chattel. It means using someone's personal property without asking. This can even happen on computers. Some courts use these rules for unwanted bulk emails.

Third, there is trespass to the person. This protects people from harm. It includes three parts. Assault is when someone makes you fear you will be hurt. Battery is when someone touches you without permission. False imprisonment is when someone stops you from moving freely.

Sometimes, people have a reason to act. For example, people in sports like rugby agree to some contact. Doctors also need permission before they treat patients. This is called consent. If a person says yes, it is often not trespass.

Trespass is a special part of law called tort law. It helps decide what happens when one person interferes with another.

There are three main groups of trespass. The first group is called trespass to the person. This protects people from being hurt or controlled. The second group is trespass to chattels. This is about personal property, like your belongings.

Trespass to the person has three main parts. The first part is called assault. This is when an act makes a person fear they will be hurt. It does not always require actual physical violence to happen. The second part is called battery. This is any intentional and unpermitted contact with a person. It can even be contact with something attached to them. The third part is false imprisonment. This is when someone's freedom to move is restrained. This restraint must be complete to count as false imprisonment. Even a short time, like fifteen minutes, can be enough.

Lawyers and courts have studied these rules for a long time. In the past, trespass to the person had six different types. These included threats, assault, battery, wounding, mayhem, and false imprisonment. Over time, many places changed these rules into the three main types we see today. Some places use different rules for how they decide who is responsible. For example, an English court case called Letang v Cooper says intent is needed for some claims. In other places, being very careless, or negligent, might be enough.

There are many specific facts about how these rules work in real life. In the case of Tuberville v Savage, a man reached for a sword but said he would not use it. The court said this was not an assault because the person was not in danger. In the case of R v Ireland, silence was even considered a way to commit assault. For property, trespass to chattel can happen on computers too. Courts have used these rules for things like unauthorized server usage.

Sometimes, people have a legal reason to act, which is called consent. If you play a sport like rugby, you consent to some contact. This is because contact is a normal part of the game. Doctors also need consent before they perform surgery on an adult. This is called informed consent if the doctor explains the risks first. If a doctor does not get permission, it can be a trespass to the person. There are also rules for how parents can discipline children. These rules say the discipline must be reasonable and used with restraint.

Trespass is a specific category within tort law. Tort law is the area of law that deals with civil wrongs. When one person interferes with another's rights, it may be considered a trespass. This legal concept is broadly divided into three distinct groups. These groups are trespass to the person, trespass to chattels, and trespass to land.

Each group protects a different type of interest, such as physical safety or private property.

Trespass to the person focuses on protecting an individual's physical safety and freedom. Historically, this category was much larger and included six separate types. These were threats, assault, battery, wounding, mayhem, and false imprisonment. Over time, many legal jurisdictions simplified these into three main types. These modern categories are assault, battery, and false imprisonment. The rules for these can change depending on where you are in the world.

Assault is the first part of trespass to the person. In many places, assault is both a crime and a tort. It occurs when an act creates an apprehension of battery. This means the person feels they are about to be physically harmed. Actual physical violence is not always required for an assault claim. For example, a person's threats could constitute assault. However, the threat must create a reasonable expectation of immediate violence. If a person reaches for a sword but says they will not use it, a court might find no assault occurred.

Battery is the second type of trespass to the person. It is defined as any intentional and unpermitted contact with a person. This contact can include anything attached to the person's body. To determine liability, courts often use a four-point test. This test looks at directness, intent, bodily contact, and consent. Some jurisdictions use the idea of "substantial certainty" instead of direct intent. This means if a person knows their actions will definitely cause harm, they are responsible.

False imprisonment is the third type of trespass to the person. It involves the restraint of a person's freedom of movement. This restraint does not always require physical force. For example, an employee might tell a person they cannot leave a room. For it to be false imprisonment, the restraint must be complete. A partial obstruction, like blocking only part of a path, is usually not enough. Even a short detention, such as fifteen minutes, can be considered false imprisonment.

Trespass to chattel involves the interference with personal property. This is often called "intermeddling" with someone else's belongings. Unlike some other types of trespass, you do not always have to prove damages occurred. This concept has even expanded into the digital world. Courts have applied these principles to resolve cases involving unauthorized server usage.

This includes issues like unsolicited bulk e-mail. It shows how old laws can apply to new technology.

Finally, trespass to land involves wrongful interference with property rights. This is the type of trespass most people think of first. It occurs when someone enters land that they do not have permission to use.

In common law, any unauthorized entry was considered a trespass. However, modern rules like the Restatement of Torts have changed this. Now, unintentional entries often only result in liability if they involve negligence. This means the person was careless or engaged in a dangerous activity.

There are important defenses that can prevent a trespass claim. The most common defense is consent, or "consensual privilege." For instance, people playing rugby consent to the physical contact expected in the sport. Doctors also rely on consent, specifically "informed consent," before performing surgery. They must explain the risks to a competent adult first. In some places, parents may also use reasonable corporal punishment for discipline. However, unreasonable or violent punishments are not protected by law.
