Australia operates under a written document called the Australian Constitution. This document establishes the nation as a constitutional monarchy and a parliamentary democracy.

It also functions as a federation. In a federation, power is divided between a central federal government and various state governments. This system has remained stable since Federation in 1901. The Constitution is actually the tenth oldest in the world. It sets the rules for how the nation is governed and how power is shared.

To prevent any single group from having too much control, Australia uses the principle of the separation of powers. This principle divides government into three distinct branches. The first is the legislature, known as the Parliament, which proposes and debates laws. The second is the executive branch, which includes the prime minister, the cabinet, and government departments. This branch administers the laws. The third is the judicature, which consists of the High Court of Australia and other federal courts. The judicature arbitrates cases regarding the administration of laws.

Interestingly, the Westminster tradition means there is no strict separation between the executive and legislative branches. Ministers are required to be members of the legislature as well.

The federal Parliament is bicameral, meaning it consists of two separate chambers. The first chamber is the House of Representatives, often called the lower house. It currently has 151 members. These members represent individual electoral districts. The number of members from each state depends on that state's population. For example, New South Wales has 48 members, while Tasmania has only five.

The second chamber is the Senate, or the upper house. It has 76 members in total. This chamber is designed to provide equal representation for the states.

The Senate's structure ensures that smaller states retain influence over national laws. Each of the six states elects twelve senators. This happens regardless of how many people live in the state. In contrast, the two internal territories, the Australian Capital Territory and the Northern Territory, each elect only two senators. This balance prevents the most populous states from passing laws without the support of the smaller states. The House of Representatives is elected based on population, which reflects the differing sizes of the states. This unique mix of systems is sometimes called a "Washminster mutation."

Australia's federal nature means different levels of government have specific responsibilities. The federal government handles matters like defence, inter-state trade, and bankruptcy. The states are responsible for different areas, such as hospitals and schools.

Additionally, states can refer certain powers to the Commonwealth government. For instance, they have allowed the Commonwealth to regulate corporations. The federal government can also influence state laws through tied grants. These are funds provided with specific conditions attached. This is important because states often have limited ways to raise their own revenue.

The monarch serves as the symbolic head of state for Australia. Currently, the monarch is King Charles III. Because the monarch is the sovereign of the United Kingdom as well, the roles are separate. The Australian Parliament passed the Royal Style and Titles Act 1953 to clarify this. This act gave the monarch the title Queen of Australia. In 1973, further titles related to the United Kingdom were removed. In practice, the monarch is represented locally by the governor-general.

The governor-general performs most ceremonial and constitutional duties. The prime minister, currently Anthony Albanese, serves as the head of government.

Changes to the Australian Constitution are not easy to make. The Parliament can propose changes, but they must go to a referendum. A referendum is a vote involving all Australians of voting age. To pass, a proposal must achieve a "double majority." This means it needs a majority of all votes cast nationwide. It also needs a majority of votes in a majority of the states. In 1999, Australians voted on a proposal to replace the governor-general with a president. That proposal was defeated. Some groups, like the Australian Republican Movement, continue to campaign for an end to the monarchy.
