In a criminal case, a person is accused of a crime. A public prosecutor is often the other party. Police may take a defendant into custody. To go home, they might have to pay bail. This is a sum of money. For very serious crimes, a judge may say no to bail. Most defendants must show up for every part of the trial. If many people are accused together, they are called co-defendants.

In a civil case, the rules are different. A defendant is accused of a civil wrong. This might be a broken contract. The person who starts the case is called a plaintiff. Most defendants are real people. However, a defendant can also be an object. This is called an in rem case. In one old case, the defendant was forty barrels of soda. Today, this often happens with money or goods.
